Hylla to hear motions Thursday in Accutane case

09/24/2009 - Madison County Circuit Judge David Hylla is scheduled to hear motions Thursday in a medical malpractice case against a local dermatologist who prescribed the acne medicine Accutane.
Godfrey native Jason Peipert sued Dr. Daniel Goran of Edwardsville, Hoffman LaRoche Inc., and Roche Laboratories in 2003, claiming he developed Crohn's Disease, an inflammatory bowel disorder, after using the drug Goran prescribed 10 years ago.
The case had been set for trial in August, but Hylla continued it until Oct. 19.
Peipert claims he developed Crohn's disease, an inflammatory bowel disease after taking the drug. He claims Goran failed to warn him of potential risks and side effects and negligently prescribed Accutane because it is difficult to manage in patients.
Defendants Hoffman LaRoche Inc. and Roche Laboratories pulled the drug from the U.S. market after juries awarded at least $33 million in damages to patients claiming bowel disease.
Peipert's suit seeks damages of at least $50,000 and costs.
Hylla had previously denied an attempt in 2007 by the plaintiff to amend the complaint to include counts of punitive damages. Peipert moved to add the punitive damages counts again in December of that year.
The defendants are represented by John Galvin and William Gage.
